These Terms and Conditions ("Terms") govern your use of the La Bajura Nosara Vacation Rentals website and the reservation of accommodations offered by La Bajura Nosara ("La Bajura," "we," "our," or "us").
By accessing our website, making a reservation, or staying at one of our properties, you agree to be bound by these Terms.
1. Reservations
All reservations are subject to availability and confirmation by La Bajura.
A reservation is not guaranteed until:
The booking request has been accepted by La Bajura;
Required guest information has been provided; and
Any required deposit or payment has been received.
We reserve the right to decline or cancel reservations at our discretion if booking information is inaccurate, incomplete, fraudulent, or violates these Terms.
2. Guest Eligibility
The person making the reservation must:
Be at least 21 years of age;
Have legal authority to enter into binding agreements;
Provide accurate and complete information during booking.
The primary guest is responsible for all occupants of the property during the stay.
3. Payments
Rental rates, taxes, fees, and payment schedules are displayed during the booking process.
By submitting payment information, you authorize La Bajura to charge the applicable amounts associated with your reservation.
Additional charges may apply for:
Property damage
Excessive cleaning
Missing items
Late check-out
Violation of house rules
All rates are quoted in U.S. Dollars unless otherwise stated.
4. Security Deposits
Certain reservations may require a security deposit.
Security deposits may be used to cover:
Damage to the property
Missing items
Excessive cleaning
Violations of these Terms
Unused portions of the security deposit will be refunded according to the property's stated procedures.
5. Cancellation Policy
Cancellation policies may vary by property and booking type.
Refund eligibility depends on:
Date of cancellation
Arrival date
Applicable booking terms
Non-refundable fees and taxes
No refunds will be issued for:
Weather conditions
Flight delays or cancellations
Personal emergencies
Early departures
Unused nights
unless otherwise required by law.
6. Check-In and Check-Out
Guests must comply with designated:
Check-in times
Check-out times
Access instructions
Early check-in or late check-out may be available upon request but is not guaranteed.
Additional fees may apply.
7. Occupancy Limits
The number of guests staying at the property may not exceed the maximum occupancy listed for the property.
Unauthorized guests may result in:
Additional charges;
Immediate termination of the reservation; and/or
Removal from the property without refund.
8. House Rules
Guests agree to comply with all posted house rules, including but not limited to:
Noise restrictions
Parking regulations
Waste disposal requirements
Community regulations
Pet policies
Failure to comply may result in additional charges or termination of the stay without refund.
9. Prohibited Activities
The following activities are strictly prohibited:
Illegal activity of any kind
Parties or events without written approval
Commercial use of the property
Excessive noise or disturbances
Damage to property
Smoking inside the property
Violations may result in immediate eviction without refund.
10. Property Condition
Guests agree to maintain the property in a clean and respectful manner.
Guests must promptly report:
Damage
Safety concerns
Maintenance issues
The primary guest is responsible for damage caused by any member of the rental party.
11. Pets
Pets are only permitted in designated pet-friendly properties and only with prior approval.
Additional fees, restrictions, and cleaning requirements may apply.
Unauthorized pets may result in penalties or termination of the reservation.
12. Force Majeure
La Bajura shall not be liable for delays, cancellations, interruptions, or inability to provide accommodations resulting from circumstances beyond our reasonable control, including:
Natural disasters
Severe weather
Flooding
Earthquakes
Pandemics
Government actions
Utility outages
Civil disturbances
In such cases, refunds or credits will be provided only to the extent required by applicable law.
13. Limitation of Liability
To the maximum extent permitted by law, La Bajura shall not be liable for:
Personal injury
Property loss
Theft
Damage to personal belongings
Travel interruptions
Indirect, incidental, special, or consequential damages
Guests assume responsibility for their own safety and the security of their personal property.
14. Indemnification
Guests agree to indemnify and hold harmless La Bajura, its owners, managers, employees, agents, and affiliates from claims, liabilities, damages, costs, and expenses arising from:
Guest conduct;
Violation of these Terms;
Damage caused by guests or invitees;
Improper use of the property.
15. Website Use
Users agree not to:
Interfere with website operation;
Attempt unauthorized access to systems;
Upload malicious software;
Use the website for unlawful purposes.
We reserve the right to suspend access to users who violate these Terms.
16. Intellectual Property
All website content, including:
Text
Images
Logos
Branding
Property descriptions
Graphics
is owned by or licensed to La Bajura and may not be copied, reproduced, or distributed without prior written permission.
17. Privacy
Your use of our website is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Costa Rica, without regard to conflict of law principles.
Any disputes arising from these Terms or your stay shall be subject to the exclusive jurisdiction of the courts located in Costa Rica.
19. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
20. Changes to These Terms
La Bajura reserves the right to modify these Terms at any time.
Updated Terms will be posted on this page with a revised effective date.
Continued use of the website or property after changes become effective constitutes acceptance of the updated Terms.
